THOMAS A FOLEY: It's bad enough when a person is charged with a crime. But when the allegation involves your own family, whether it be your spouse or your child, that can be very difficult for the client.
Many good parents are shocked when they come to my office and they're charged with criminal wrongdoing against their own child, whom they love dearly and were simply trying to exercise good parental discipline. Generally speaking, it's always a bad idea to speak with the police about a criminal allegation involving domestic violence without an attorney being present. The process can be very invasive when the police and the state of Delaware essentially intrude upon your household and accuse you of doing something criminal against a loved one. And I understand that. And it's very important that the authorities are not given the power to strip you of your access to your own house, to your family, and to your kids.
Most cases involve really good people, who in s split second lose their cool or let their emotions get the best of them. And it's my job to simply put it back in context and remove the criminality from the incident.
